Introduction

Nayax Ltd. (“Nayax”, “we” or “our”) is committed to protecting your privacy and operates in accordance with the Protection of Privacy Law.

This Privacy Policy (the “Policy”) explains how we collect and process information about you in the context of the Wallyx loyalty program (the “Loyalty Program”), when you use Nayax’s Wallyx application, which enables you to accumulate coins when purchasing products and services through Nayax devices and to convert such coins into vouchers and redeem them to receive benefits at participating merchants (the “Application”). This Policy forms an integral part of the Application’s Terms of Use [Terms of Use].

This Policy is written in the masculine form for convenience only, but is intended for all genders. This Privacy Policy is intended for private consumers only and does not apply to companies or other business entities.

We do not knowingly collect, store, or process personal information of minors under the age of 13, as participation in the Loyalty Program is intended for Israeli residents aged 13 and above. If we become aware that personal information of a child under 13 has been collected, we will delete it promptly.

This Policy may be updated from time to time. If we do so, we will proactively notify you of the updated policy.

What Information We Collect and Why

We process your personal information based on your consent and as necessary for the performance of the Loyalty Program and provision of the Application.

The information we collect about you when you use the Application and register for the Loyalty Program includes your name, phone number, email address, contact details, application login details, details of purchases of products and services made through Nayax devices, conversion activities relating to the coins accumulated in your account, and redemption of benefits at merchants.

Information About Your Use of the Application

We also collect statistical information regarding your characteristics and your use of the Application, for the purpose of improving the user experience and ensuring the proper and ongoing operation of the Application.

You are not legally required to provide your information, and doing so depends on your consent and free will. However, if you choose not to provide such information, you will not be able to participate in the Loyalty Program.

We may use analytics tools and similar technologies to collect technical and usage data in order to improve the Application’s performance and user experience.

Methods and Sources for Collecting Your Personal Information

We collect your personal information from several sources:

• Directly from you, when you register for the Application or the Loyalty Program, or when you provide us with information, for example via email or any other communication channel;
• Through the Application itself, which collects information about you during your use of it.

Sharing Your Personal Information

We will not share your information with third parties, except in the circumstances detailed below or where you provide us with your explicit and informed consent.

As part of the Loyalty Program and as detailed in the Terms of Use, available here [Terms of Use], vouchers may be redeemed at participating merchants (“Merchants”). In such cases, we will share your information with Merchants participating in the Loyalty Program in order to enable voucher redemption and allow you to enjoy the benefits offered by the Merchants. Merchants are not permitted to use the personal information transferred to them for any other purposes without your explicit consent. Nayax is not responsible for the manner in which Merchants process or store your personal information.

We use service providers who assist us in processing information. We share information with them solely for the purpose of providing the Application and its functionalities. These parties are not authorized to use the information for their own business purposes.

We will disclose your information if required to do so by law or by order of a competent authority.

We will disclose your information in emergency situations where such disclosure is essential to protect or save lives—yours or those of others.

We will transfer your information in the event that Nayax undergoes a sale of assets, merger, acquisition by another company, or insolvency, in which case the information will be transferred to the entity intended to step into Nayax’s position and operate the system.

We do not sell your personal information to others.

Data Retention and Security

We retain your personal information for as long as necessary to operate the service and thereafter as required to comply with legal obligations, resolve disputes, establish or defend legal claims, and enforce our agreements.

We are certified under ISO 27001 and SOC 2 information security standards and implement measures to reduce the risks of damage, loss of information, and unauthorized access or use. These measures include data encryption, risk and threat assessments, security measures in our systems, and more. However, these measures do not provide absolute information security. Therefore, despite efforts to safeguard your personal information, there is no guarantee that it will be immune to information security risks.

Your personal information may be stored or processed on servers located outside Israel, including in jurisdictions that may have different data-protection laws. In such cases, Nayax takes reasonable measures to ensure appropriate protection of your personal information.

Your Rights and How to Exercise Them

Since we process information about you, you have the following rights:

• The right to access and review your personal information that we process and to receive a copy thereof, subject to the limitations set forth by law.
• The right to correct or delete inaccurate personal information held about you, as well as to complete incomplete personal information, subject to the limitations set forth by law.

If you wish to exercise these rights, please contact us using the details provided at the beginning of this Policy. We reserve the right to request reasonable evidence to verify your identity before providing you with information. In cases where we are unable to provide you with the information you requested, we will explain the reason for this.

You may withdraw your consent to the processing of your personal information at any time by contacting us; however, withdrawal of consent may prevent continued participation in the Loyalty Program.
